Family as the smallest system of law-based society is based on the obedience of spouses which that leads to family and community consolidation. For this reason, the husband and wife should support each other through kindness and be the guardians of the family's survival and also preserve each other's chastity. Sometimes there is a conflict between the rights of spouses in the family; thus, in order to find the appropriate solutions to solve those conflicts, jurisprudential and interpretive sources must be consulted. Among the rights which there might conflict be found in the family is the right of wife's submission to husband, and the bodily privacy of the wife. The verses of the Qur'an, traditions and consensus texts explicitly indicate the right of husband's to be obeyed and it is made obligatory. Through inhering human nature, reasoning and tradition also the physical integrity of the wife is emphasized. By comparing and examining the submission's obligation arguments and preserving bodily privacy arguments, the divine law seems to adhere to the wife's bodily privacy and considers it as an example of good etiquette and reasonable behavior between spouses to be observed.
